The Florida Police Chiefs Association endorses
Supporting International Association of Chiefs of Police White Paper on Enforcing Immigration
Law: The Role of State, Tribal and Local Law Enforcement
WHEREAS, the International Association
of Chiefs of Police, hereafter referred to as the IACP, completed an extensive and complete
study of the impact of the H.R. 2671 commonly referred to as the "CLEAR Act 0f 2003
WHEREAS, the study shows that the CLEAR
Act causes confusion over Immigration Laws regarding Criminal Versus Civil Violations; and
WHEREAS, the study shows that the CLEAR
Act does not adequately consider the training requirements for complex immigration laws,
or the cost of that training; and
WHEREAS, , the study shows that the
CLEAR Act does not address local law enforcements limitations on arrests without a warrant;
and
WHEREAS, the study shows that the CLEAR
Act does not address many of the liability concerns for local law enforcement; and
WHEREAS, the study shows that the CLEAR
Act has a chilling effect on immigration cooperation by local law enforcement; and
WHEREAS, the study shows that the CLEAR
Act will put additional enforcement burdens on already over burdened local law enforcement,
and will reduce partnerships with our immigrant community
THEREFORE BE IT RESOLVED,that the Florida
Police Chiefs Association supports the IACP stand against H.R. 2671 commonly known as the
"CLEAR Act of 2003", in its current form and language.

2005 in Tallahassee, Florida, at a duly constituted meeting of the Board of Directors
of the Florida Police Chiefs Association.
