2009 FPCA Legislative InitiativesFPCA INITIATIVE:ADEQUATE FUNDING OF THE JUVENILE JUSTICE SYSTEM: FPCA supports and urges the Legislature to sufficiently fund all aspects of the juvenile justice system to include diversion, assessment centers, treatment, pretrial detention and commitment programs. FPCA SUPPORTS:RED LIGHT CAMERAS: FPCA supports legislation that enables enforcement action based on red light cameras. PRIMARY SEATBELT ENFORCEMENT: FPCA supports legislation authorizing primary enforcement of seatbelt violations. BULLET RESISTANT MATERIALS: FPCA supports legislation prohibiting the possession of bullet resistant materials by Felons and delinquents. OFFENDER MONITORING: FPCA supports legislation that requires high risk offenders not in confinement to be subject to continuous electronic monitoring using a system that reports the offenders' presence near a crime scene, entrance into prohibited areas, and departure from a geographical area(s) where their presence is limited. FLORIDA PARTNERS IN CRISIS: FPCA supports the work of the Florida Partners in Crisis advocacy efforts on behalf of mental health and substance abuse services for people in need, Further FPCA supports their efforts to obtain funding to continue these services. ADEQUATE FUNDING OF THE COURT SYSTEM: FPCA believes it is in the best interest of law enforcement to have an adequately funded judicial system. PRESCRIPTION DRUG MONITORING PROGRAM: FPCA supports the Prescription Drug Monitoring Program wherein funding is provided by Federal, Private or Grant assistance programs. HB 173 & SB 654: FPCA supports HB 173 & SB 654 that restores some discretion to the juvenile judges so judges could lawfully impose reasonable conditions of pretrial release (e.g. curfew, obedience to parents, school attendance, etc.) and so that judges might regain the ability to impose appropriate and meaningful reasonable sentences for juvenile offenders. HB 1151 & SB 2276: FPCA supports HB 1151 & SB 2276 that provides for the collection of DNA samples on all felony arrestees. FPCA OPPOSES:LAW ENFORCEMENT FUNDED TRAINING: FPCA opposes any cuts to existing training dollars for law enforcement officers. FDLE SERVICES: FPCA opposes any cuts that reduce critical services to local law enforcement, most importantly Crime Labs, Criminal Investigations and Criminal Justice Information. 911 EMERGENCY DISPATCH CERTIFICATION REQUIREMENTS: FPCA opposes efforts to change the 9-1-1 dispatcher certification requirements from voluntary to mandatory. ACCIDENT RESPONSE FEES: FPCA opposes any efforts to restrict local government's ability to recover accident response fees. PAROLE BOARD: FPCA opposes the elimination of the Parole Board from its current configuration. ADMINISTRATIVE INVESTIGATIONS: FPCA opposes any legislation that limits the ability of law enforcement managers to conduct internal and/or administrative investigations as a responsible matter of obligation to the public trust to maintain the highest standards of ethics in government. CUSTODIAL INTERROGATIONS: FPCA opposes any legislation that limits the introduction into a court of law any evidence that would provide a jury the ability to evaluate all issues, inclusive of confessions and admissions. DART FIRING STUN GUNS: FPCA opposes any limitations on the proper deployment of non-lethal weapons such as electronic control devices (stun guns) used to deescalate violence on school grounds or other arbitrary considerations. HB 195 & SB 870: FPCA opposes HB 195 & SB 870, the companion bills would mandate that local public employers (e.g. school districts, county and municipal governments, police departments, sheriffs, water management districts, etc.) conduct a single annual employee charitable campaign and require them to include in the campaign any federation - and member agencies of the federation - that complies with the bills’ requirements. Currently, local public employers can include any legitimate charity or federation they deem appropriate. SB 1842: FPCA opposes SB 1842 would exempt certain applicants for employment as part-time auxiliary law enforcement officers from a requirement that they complete a basic training program. ASSET FORFEITURE FUNDS: FPCA opposes any bill that would alter the distribution of asset forfeiture funds. TRUCK WEIGHT INCREASES: FPCA opposes truck weight increases because they will have a negative impact on highway safety and infrastructure. |
