
WHEREAS, the Association is committed to improving the effectiveness of law
enforcement throughout the state, and;
WHEREAS, the Association is furthermore committed to enhancing the quality of life and
safety of the millions of people who live, work and play in the State of Florida, and;
WHEREAS, it is the responsibility of the Florida Police Chiefs to inform their citizens of
issues which would enhance their safety and the safety of their children, and;
WHEREAS, the Association is aware that some counties of our state are experiencing acute
problems with violent crimes involving the use of firearms, and;
WHEREAS, the problem is exacerbated by the provisions of Florida Statute 790.33 which
preempts counties from passing any local ordinance regulating the purchase and/or sale of firearms
or ammunition, and;
WHEREAS, the Association recognizes that there are significant differences in some
counties that would strongly indicate a need for variances in how they regulate the purchase and sale
of firearms and ammunition, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED THAT, the Florida Police Chiefs
Association supports the Florida Constitutional Revision Commission's Proposition Number 12, amending Article VIII, Section 5 of the Florida Constitution, allowing
counties a local option to require a criminal history check and a 3 to 5 day waiting period in connection with the sale of firearms on property open to public access.
