FPCA Contact and Consent:On July 3, 2003, the Federal Communications Commission (FCC) issued a Report and Order amending the regulations that implement the federal Telephone Consumer Protection Act (TCPA). While most of the national attention was directed to the national "Do-Not-Call" list, a less publicized but equally sweeping change was made to the rules governing contacts made via fax machine. These changes will have a major impact on the way that non-profit organizations such as the Florida Police Chiefs Association contact their members, vendors and customers. The new rules, which become effective 30 days after they are published in the Federal Register (which occurred on July 25, 2003) will require signed, written consent in order to send faxes that contain unsolicited advertisements, even to association members. E-mail and electronic consent forms will be permitted. Under the 1992 TCPA, Non-profit organizations and persons with whom a for-profit organization maintained an established business relationship were exempted from this regulation. To understand the broad implications of this regulation, consider the following scenario: If you call FPCA headquarters and ask to receive information about the Annual Meeting, we would be in technical violation of the TCPA if we sent you that information via fax without your prior written consent to receive materials from FPCA via fax (your verbal authorization over the telephone would not suffice). Similarly, if you asked for a new dues renewal form, we would not be able to fax it to you without your expressed written authorization. FPCA does not intentionally "spam" our members, vendors or customers and we value your right to privacy. While it is the belief of FPCA's headquarters staff that these new regulations are poorly thought out in terms of scope and intent, we intend to do our best to comply with them.
